SONNETT The case is called. The Court reads the Ex Parte Application in chambers and rules as follows: Defendant Hyundai Motor America’s Ex Parte Application For Order Continuing Trial Date and Final Status Conference is DENIED. No good cause shown. Due to the Court’s congested docket and COVID-19 related delays, the Court does not have any available jury trial dates before July 2023. The Court is unwilling to continue trial to a date over 1-1/2 years out. As an alternative, the Court will advance and specially set the hearing on Defendants Motion for Summary Judgment for December 21, 2021, at 8:30 a.m. Defendant has sufficient time to file the motion and provide proper notice pursuant to Code of Civil Procedure section 437c(2) and allow Defendant to present the issues before trial. The Court notes that the Trial date was set over a year ago at the Case Management Conference conducted on August 10, 2020. Defendant stated they would be ready for trial on that date. Therefore, Defendant has had ample time to plan for and draft the motion for summary judgment, and have it ready to file pursuant to the deadline imposed under Code of Civil Procedure section 437c(3) based upon the current trial date, as well as anticipate the Christmas Holiday and New Year Holiday season. The Court finds no good cause to shorten the time otherwise. Finally, the Court sets a Post-Mediation Status Conference for January 7, 2022, at 9:00 a.m. Minute Order Page 1 of 2
