It is ordered and adjudged that the imposition of sentence is hereby withheld and that
you be placed on Probation for a period of eighteen (18) months.
Affiant states that the offender was instructed on the conditions of Probation on February 14,2022 by Officer Castaldo.
Affiant further states that the offender has not properly conducted himself, but has violated the conditions of his probation in a material respect by:
Violation of Condition (1) of the Order of Probation, by failingto reportto the probation officer as directed, in that, on September 1, 2022, the offender was instructed
by Officer Castaldo to report to the probation office on October 5, 2022 at 10:15, and as grounds for belief that the offender violated his probation, Officer Castaldo states
that the offender failed to report as directed.
Violation of Condition (3) of the Order of Probation, by changing his residence without first procuring the consent of the probation officer, and as grounds for belief
that the offender violated his probation, Officer Castaldo states that on or about 10/13/2022, the offender did move from his last known residence at 14258 Coolidge Road
Port Charlotte, FL 33953, without the consent of the probation officer, as told to this officerby Matthew Didonato on October 13, 2022.
Violation of Condition (9) of the Order of Probation, by failing to comply with all instructions given to him by the probation officer, and as grounds for belief that the
offender violated his probation, Officer Castaldo states that on October 18, 2022, the offender was instructed to report to the probation office on October 18, 2022 by 4pm
and the offender did fail to carry out this instruction by not showing up to the probation office on October 18, 2022 as witnessed by Officer Castaldo who was here all
day.
Violation of Condition (9) of the Order of Probation, by failing to comply with all instructions given to him by the probation officer, and as grounds for belief that the
offender violated his probation, Officer Castaldo states that on October 13, 2022, the offender was instructed to stay at the probation office until our monthly appointment
was done and the offender did fail to carry out this instruction by getting in the car and leaving, as witnessed by Officer Castaldo on October 13, 2022.
Violation of Condition (11) of the Order of Probation, by refusing to submit to random testing as directed by the officer or the professional staff of the treatment center
where he is receiving treatment to determine the presence or use of alcohol or controlled substances, and as grounds for belief that the offender violated his probation,
Officer Castaldo states that the offender refused to submit to a urinalysis test on October 13, 2022, as evidenced by the offender getting in a females car and leaving the
probation office without giving a sample.
