1. I am an attorney duly licensed to practice law in this Court. I am the attorney for Plaintiffs

and have personal knowledge of the statements herein. If called to testify I could and

would competently do so.

2. I apologize to the Court for not picking-up the trial exhibits prior to the issuance of the
22
OSC. I do have a recollection of going to retrieve it one time but I noticed the Court was in
23
session and did not want to cause a disruption. Thereafter, the binder slipped my mind
24
until I received the OSC. Thereafter, I picked-up the binder and have it in my possession.

3. I apologize for putting the Court through the effort to set the OSC, and I will try to be more
26
diligent in the future, but I respectfully request that the Court discharge the OSC.
