Carter, Executive OfficertClerk of Court By: F. Becerra,Jr., Deputy "or FepensORDER DENYING PETITION FOR WRIT OF ADMINISTRATIVE This matter is before the court on a petition for writ of administrative mandate pursuant to Code of Civil Procedure 1094.5 only. (Pet., 4] 1.) On January 15, 2020, the Police Permit Review Panel (the Panel) for the City of Los Angeles Respondent, denied a Police Commission Permit (police permit) to Petitioner, 603 Investments, LLC, to operate a “topless cabaret” at 13324 Sherman Way. (AR 202.) Through its petition before this court, Petitioner 603 Investments contends the Panel’s decision constituted an abuse of discretion In addition, the petition separately alleges the City confiscated and revoked the police permit of Petitioner, Burlesque Enterprise, Inc., without due process of law for two reasons. First, the City allegedly failed to provide Petitioner Burlesque Enterprises with reasonable or proper notice of the basis for the permit’s confiscation and/or revocation. Second, the City allegedly did not give Petitioner Burlesque Enterprises an opportunity to be heard before the alleged confiscation and/or revocation Petitioners jointly request the court issue a writ of mandate setting aside (1) the Panel’s January 15, 2020 decision denying Petitioner 603 Investments application for a police permit: and (2) the City’s revocation and/or confiscation of Petitioner Burlesque Enterprise’s police permit. Petitioners further seek an order granting Petitioner 603 Investments’ application for a police permit and returning Petitioner Burlesque Enterprise’s police permit to it. The City opposes the petition The Petition is DENIED ‘AR references citations to the Administrative Record related to Petitioner 603 Investments.
