Faune ERM: None Courtroom Assistant: Theresa De La Paz Deputy Sheriff: None APPEARANCES: For Plaintiff(s): No Appearances For Defendant(s): No Appearances NATURE OF PROCEEDINGS: Court Order The Court is in receipt of an Amended Declaration of Terrell Dickerson (“Payee”) which was filed on December 15, 2020, in response to this Court’s posted tentative ruling denying the Petition for Approval for Transfer of Structured Settlement Payments. While the Amended Declaration clears up one item, it remains unclear in other respects. The Amended Declaration does clarify that Payee will be selling a one lump sum payment of $44,000 due to Petitioner on November 19, 2022 (Dickerson Decl. ¶ 10). However, Payee’s Amended Declaration states at Paragraph 12 that the remaining payments due to him under the annuity include a one lump sum payment of $36,000.00 due November 2022 and a one lump sum payment of $80,000.00 due November 2025. Initially, the Court interpreted the Declaration to mean that the $36,000.00 payment was in addition to the $44,000.00 payment Payee agreed to sell to Petitioner. However, Paragraph 9 of the Amended Declaration indicates that Payee also sold Petitioner a lump sum payment of $24,000.00 due November 19, 2022 and a lump sum payment of $20,000.00 due on November 19, 2025. Pursuant to Payee’s declaration, Payee will have due to him in November 2022 a sum of $104,000.00 and a sum of $100,000.00 due in November 2025. This is inconsistent with the letter attached to the Petition from the Payment Issuer, New York Life Insurance and Annuity Corporation, dated August 6, 2020. In the August 6, 2020 letter, New York Life Insurance indicates that the following benefits are payable to Payee as of that date: 1. $100,000.00 paid as a lump sum on 11/19/2022, guaranteed. 2. $136,997.36 paid as a lump sum on 11/19/2025, guaranteed. It thus remains unclear to the Court how much is left to be paid to Payee and when those payments are due. Minute Order Page 1 of 2
