In determining the outcome of a disputed citation, Hearing Examiners must follow the applicable law, most of which is contained in the California Vehicle Code and the Los Angeles Municipal Code. Section 40202(a) of the California Vehicle Code sets forth that the information required on a Notice of Parking Violation shall be considered a "record kept in the ordinary course of business" and "shall be prima facie evidence of the facts contained therein." _ ‘ Essentially, a complete citation establishes the facts listed upon it, without requiring‘ the testimony of a Traic Officer to verify it. A Respondent may introduce evidence rebutting certain facts on the citation, or establishing a defense or the presence of extenuating circumstances; these need not necessarily contradict facts recited on the citation. According to the citation, on 1/30/2020, at 5:08 P.M., at approximately 400 S. Crescent Heights Blvd., Respondent's vehicle was cited for a "No Stopping" violation. On 4/30/2020, Respondent participated in a telephonic hearing to contest this citation. Witness Testimony: Respondent testified that she works near the location of the citation and, as such, is familiar with parking regulations in the area. She indicated that she parked on a section of the street which only had a posted ‘ street cleaning restriction. Respondent acknowledged that another section of the street pertained to the "No i Stopping" restriction for which she was cited. Respondent submitted photos of the location and contested this citation.
