Plaintiff has (1) failed to serve the complaint and file a proof of service within 60 days of filing the complaint, in violation of Cal. Rule of Court 3.110(b); and (2) failed to serve a case management statement as required by CRC 3.725(a). Pursuant to Cal. Rule of Court 3.110(f), the Court hereby issues an order to show cause why sanctions should not be imposed in the amount of $500. Pursuant to Cal. Rule of Court 3.110(i), any response to this order to show cause must be filed under oath and served at least 15 calendar days before the hearing. Plaintiff's counsel of record shall personally appear at the next hearing by video or in person as applicable. Special appearance by counsel other than counsel of record, is not permitted. Alternatively, plaintiff may discharge the OSC by filing proof of service of the complaint no later than 15 calendar days prior to the next CMC. Plaintiff is also reminded to comply with Cal. Rule of Court 3.725(a), and shall, no later than 15 calendar days before the case management hearing, file a case management statement and serve it on all other parties in the case Compliance Hearing re OSC re Dismissal is scheduled for 03/08/2023 at 3:00 PM in Department 20 at Rene C. Davidson Courthouse. Clerk is directed to serve copies of this order, with proof of service, to counsel and to self- represented parties of record.
