FILED: NEW YORK COUNTY CLERK 04/12/2023 04:36 PM INDEX NO. 153346/2023 4/12/23, 3:53 PM - englanderplIc.com Mail Fwd: [EXTERNAL] 421A Revocation NYSCEF DOC. NO. 9 RECEIVED NYSCEF: 04/12/2023 Alexa Englander Fwd: [EXTERNAL] 421A Revocation 1 message Jonathan Giahn Mon, Apr 10, 2023 at 5:33 PM "alexa@englanderpilc.com" To: ---------- Forwarded message --------- From: Veale, Emily (HPD) Date: Mon, Dec 19, 2022, 1:15 PM Subject: RE: [EXTERNAL] 421A Revocation To: Jonathan Giahn Cc: CEDocketCompliance , 421aRentRegistration <421aRentRegistration@hpd.nyc.gov> Thank you. Regarding this property, the 421-a tax benefit was revoked on July 27, 2022 for failure to submit annual rent registrations to DHCR from 2017-2021. HPD sent an initial Notice of Impending Revocation on April 14, 2022 notifying the owner that if the above rent registrations were not submitted by July 13, 2022, the 421-a benefit would be retroactively revoked. After receiving no response HPD issued the Determination Notice on July 27, 2022 and notified DOF to revoke the benefit. You have the option of having the benefit retroactively restored by agreeing to a settlement in which you would: 1. Pay a 25% penalty of the total amount of the 421-a tax benefit received since coming out of compliance (January 1, 2017); 2. Agreeing to extend the building's rent stabilization status for an additional 15 years starting from the date of the settlement agreement; and 3. Coming into compliance with the 421-a program by filing the annual rent registrations with DHCR for all years since January 1, 2017. All settlements are subject to approval from the comptroller's office and we cannot circulate the agreement until we receive approval from them. We can also reach to DHCR to confirm the total amount of the revoked benefit and the 25% penalty amount. Let me know if you have any questions or if you would like to proceed with the settlement agreement. Before discussing further, we also need an owner authorization signed by all owners that includes the information in the memo I've attached to this email. Regards, Emily Veale, Esq.
