The Court set a bench trial [for the Rogachevsky matter] on Plaintiff’s UCL claim 3 against Defendant DepositIQ and a UCL conspiracy claim against the Mosser 4 Defendants for November 16, 2023. 5 2. Plaintiff’s utility splitting claims in Rogachevsky VS Mosser RG21100506, BOULAKDEM VS MOSSER RG 21100186, and Rosenberg, RG21100160), shall be 6 dismissed without prejudice and included in the Yen class action case. Those claims will be tried in Court on March 15, 2024 at 10:00am in Department 21 [for the Yen 7 matter]. The parties are to prepare a stipulation to dismiss the claims without prejudice 8 and for the filing of an amended complaint containing utility and software claims. 9 3. Rogachevsky VS Mosser RG21100506, BOULAKDEM VS MOSSER RG 21100186, and Rosenberg v. Mosser, RG21100160, and Annus VS Mosser RG21100259, are 10 consolidated for discovery and case management purposes. The lead case shall be Rosenberg, RG21100160. All filings in all of the cases shall be made under 11 RG21100160 and shall indicate on the caption that the case is consolidated under Case 12 No. RG21100160, and shall also contain the case number of the individual case. The parties are to file one joint case management statement in narrative form 13 addressing/raising case management issues in all of the consolidated cases. The court reserves on the issue of consolidation for the purposes of trial. The court anticipates 14 that the tenant protection claims and the tenant harassment claims and reduction in service claims will be addressed in the consolidated action 15 16 4. Parties are to submit briefs to the court not exceeding five pages in length addressing the issue of whether discovery taken in the consolidated action may be used in each 17 individual case, to be filed with CMC Statements. 18 19 CURRENT STATUS OF REMAINING CASE MANAGEMENT ISSUE 20 The parties in the Yen matter hereby submit their joint case management statement pursuant to the 21 Court’s January 3, 2023 Case Management Conference Order and pursuant to the Court’s February 17, 22 2023 Case Management Conference Order. The parties briefly address herein the current status of this 23 matter. 24 The parties acknowledge the Court’s setting of the March 15, 2024 bench trial date to resolve the 25 equitable UCL claims. The parties also acknowledge that the Court intends for Plaintiffs to bring their 26 motion for class certification prior to March 15, 2024. The parties have not yet met and conferred as to 27 the precise timing of the class certification motion. 28 2 JOINT CASE MANAGEMENT CONFERENCE STATEMENT 1 As to the parties’ discovery efforts, Plaintiffs served each of the Defendants1 with discovery 2 requests on February 28, 2023.
