Based upon the attached affirmation (“Affirmation”) of Jack A. Franceschetti, an attorney
with the New York Liquidation Bureau, the organization that carries out the duties of Adrienne
A. Harris, Superintendent of Financial Services of the State of New York as ancillary receiver
(“Ancillary Receiver”) of Bedivere Insurance Company (“Bedivere”), dated June 3, 2022, and
upon all other papers previously submitted and all proceedings heretofore had herein;
AND, it appearing from the Affirmation and attachments thereto that the interests of
Bedivere, in ancillary receivership, its creditors, and all others interested in the affairs of
Bedivere will best be served by the approval of the recommendation of the Ancillary Receiver
as to the allowance and payment of the claim set forth in the schedule attached to the
Affirmation;
NOW, based upon the application of the Ancillary Receiver, it is
ORDERED, that the relief requested in the Affirmation is granted; and it is further
ORDERED, that the recommendation made by the Ancillary Receiver, as set forth in the
Affirmation, regarding the allowance of the claim in the amount set forth in the schedule
attached thereto, be and the same hereby is approved; and it is further
ORDERED, that the Ancillary Receiver is directed to provide the Commissioner of
Taxation and Finance, as Custodian of the New York Property/Casualty Insurance Security
Fund, with the appropriate certificates to effectuate payment of such allowed claim; and it is
further
ORDERED, that the amount recommended for payment by the Ancillary Receiver be
paid out of the New York Property/Casualty Insurance Security Fund, pursuant to Section 7603
of the New York Insurance Law; and it is further
ORDERED, that the Ancillary Receiver is directed to pay in full, without interest, the
amount allowed of $150,000.00, payable to K. C., Claim No. R900000002064-00002, as listed in
the schedule attached to the Affirmation.
