                               Real Party in Interest Skinny Labs Inc. d/b/a/ Spin (“Spin”) opposes Petitioner, Bird

                    Rides, Inc. (“Bird”)’s Motion for a Preliminary injunction against Respondent, the City of Santa
           24
                    Monica. The motion should be denied for the following reasons:

                          1. There is no reasonable probability that Bird will prevail on the merits because the City’s
           26
                               decision to select Spin was neither abusive nor illegal; all of Spin’s devices are legal, and
           27
                               Spin’s offerings are more widely accessible than Bird’s, advancing the City’s stated
           28
                               program goals.
