and upon all the pleadings and proceedings heretofore had herein, the plaintiff, will cross-move this
Court at IAS Motion Support thereof, at the Courthouse located at 360 Adams Street, Brooklyn,
New York, on the 15th day of March, 2023 at 9:30 o'clock in the forenoon of that day or as soon
thereafter as counsel can be heard for an order: (1) pursuant to CPLR section 510 [3] retaining venue
of this case in Supreme Court, KINGS County to prevent inconvenience to plaintiff’s treating doctors
at the time of trial, and; (2) denying defendants motion seeking to change venue to Rockland County
Supreme Court, and; (3) for such other and further relief that this Court deems just, proper, and
equitable in favor of plaintiff under the circumstances.
PLEASE TAKE FURTHER NOTICE, that pursuant to CPLR §2214 (b), this Cross-Motion is
being served upon you via Electronic Filing (NYSCEF) more than seven (7) days prior to the return
date of the notice. Any answering affidavits, if any, are to be served upon this office at least three (3)
days prior to the return date of this notice.
