Dear Justice Sciortino:
This office represents the County of Orange in this matter. This office has filed a
summary judgment motion in this matter, which motion is fully submitted. The respondent filed
a bankruptcy petition with the United States Bankuptcy Court for the Southern District of New
York on August 3,2021, which stayed the proceeding before this Court. This Court setup a
control date oftoday for a status report.
The bankruptcy petition and automatic stay remain in place. The Trustee had filed a
motion to dismiss the case. However, I understand that that the Respondents have made
sufficient payments into the plan such that the Trustee has withdrawn the motion.
