Although Defendant vowed t0 have a court reporter present for the “Pitchess” hearing, none was present when
the court began or concluded the hearing.
Prior to recessing incourt, Lt. Salazar was sworn.
Lt. Salazar, Counsel for the County and the Court adjourned to Chambers at 10:21 a.m.
Lt. Salazar was asked by the Court if he had retained or failed to provide any of Plaintiffs records, to which he
replied, “No. Ibrought the entire file.”
The court reviewed the non-medical personnel file; no records were relevant to the request and, as such, will
not be disclosed.
The court reviewed the approximately 1/2”medical file.
The couIt finds that the medical records fromlthe present incident relevant and will be disclosed.
The County will redact any personal information such as home addreSs, CDL, SSN, etc. (ifany exists) prior to
the disclosure on January 3, 2020.
Both Plaintiff and Defendant will be provided copies under and pursuant to a protective order that counsel for
County will draft and this court will sign. Production will not occur if protective order is not signed.
All records produced shall be returned (including any copies made) to the custodian, Lt. Salazar, at the end of
the litigation.
