In this action to recover damages for medical malpractice, The Fitzgerald Law Firm, P.C., moves
pursuant to CPLR 321(b)(2) for leave to withdraw as attorney for the plaintiff, Wanda Collado, as Parent
and Natural Guardian of A.P., an infant. The defendant does not oppose the motion. The court heard
oral argument, at which the plaintiff herself appeared.
Upon the foregoing papers, it is
ORDERED that the motion is denied, without prejudice to renewal after the defendants pending
summary judgment motion is determined; and it is further,
ORDERED that the return date of the defendants pending summary judgment is adjourned until
April 22, 2022, and shall be heard on papers only, without oral argument.
