coilii.ection with accident from which this actions arises, uicluding but not limited to his
background, medical training and expertise, the scope of the Plaintiff's treatment, and

To Whom It May Concern:
As per your request, I performed an independent orthopedic examination on the
above-claimant on September 29, 2016 in my Q ueens, New York office. The
claimant presented valid photo identification, which was witnessed and copied.
My findings of the examination are as follows:
HISTORY:
Mr. Garrett states that he was involved in a trip-and-fall accident on August 14,
2015. The claimant explains that while walking he stepped on a crack in the
down"
sidewalk and "went straight (he reports that a piece of pavement was
missing, which caused him to trip and fall). He sustained reported injuries to the
lower back, left hip, bilateral knees and right ankle. There were no lacerations or
loss of consciousness as a result of this accident. The claimant went to Nassau
University Medical Center Emergency Room, via ambulance, where radiology
testing was performed of his back, right knee and right ankle. He was treated with
medication and released the same day. Prior to being discharged he was provided
with a cane and an ACE bandage.
TREATMENT HISTORY TO DATE:
The claimant was prescribed medication and physical therapy. He also received
injections to his lumbar spine as per the procedure reports. Mr. Garrett states that
he does not feel any better now than when he initially began with therapy; he gets

approxirnately 20 minutes of short-term relief following.treatment sessions, but he
also reported the "pain is still there". Currently he is continuing to receive physical
therapy 2 times per week.
The examinee was provided with medical supplies, which included a back brace,
an ankle brace, a knee brace and a pair of crutches.
Mr. Garrett underwent right knee surgery on 3/1/16 as per the operative report.
PAST MEDICAL / SURGICAL HISTORY:
Past medical history, as reported by the claimant, is significant for asthma.
The claimant denies any prior accidents or similar conditions.
Prior surgical history, as reported by the claimant, is significant for surgery due to
"broken"
a right tibia (December 2003), right knee arthroscopic surgery (August
2011), right osteachondral allograft with removal of tibia hardware (November
2011) and right knee arthroscopic surgery (September2012).
MEDICATIONS:
The claimant indicates he is taking Aleve, Motrin, Zanaflex and Percocet at this
time.
EMPLOYMENT HISTORY:
Mr. Garrett states that he was unemployed at the time of the August 14, 2015
accident and that he is not working now.
CHIEF COMPLAINTS:
This individual stated that he feels pain in the lower back, left hip, bilateral knees
and right ankle.
Mr. Garrett rates his pain 7/10 today (with 10 being the worst). He indicates he
took Aleve prior to today's examination, which helped to reduce his pain "a little".
He describes his pain as achy, sharp, stabbing, nagging and tingling (he further
explained the following, "constant radiating feeling like [the] back is going to
break"). The pain is reported to radiate from his back through the buttocks and
down the right leg. He is able to walk approximately 1 city block (or for 10 minutes)
without experiencing too much pain. Climbing stairs causes him difficulty. He can
sit for approximately 10-15 minutes at a time. His pain is worsened by activities
long"
such as bending, walking, sleeping, sitting for "too long", standing for "too
