                 PLEASE TAKE NOTICE, upon the Memorandum of Law dated February 1, 2023 and

          Affirmation of Stephen M. Baldini dated February 1, 2023, together with exhibits thereto,

          Defendant Fiorello Pharmaceuticals, Inc., by and through its counsel, will move this Court at New

          York Supreme Court, New York County, 60 Centre Street, Room 130, New York, New York, on

          February 24, 2023 at 9:30 a.m. or soon thereafter as counsel may be heard, for an Order pursuant

          to CPLR §§ 2201 and 5519(c) for a stay pending the expedited appeal of the December 2, 2022

          and December 5, 2022, orders in this action.


                 PLEASE TAKE FURTHER NOTICE that, pursuant to CPLR 2214(b), any opposition

          papers and/or cross motions with supporting papers, if any, shall be served on the undersigned

          counsel at such time as the Court may direct but at least seven (7) days prior to the return date of
