       MOTION FOR FINAL HEARING/REQUEST FOR RULE NISI

     Jermaine Smalls (hereinafter, “Plaintiff”) hereby files the following Motion to

For Final Hearing/Request for Rule Nisi, and states as follows:

      1. On January 9, 2023, this Court entered an Order Granting Plaintiff’s

         Motion for Partial Summary Judgment (on Liability Only) (hereinafter the

         “Summary Judgment Order”).

      2. In the Summary Judgment Order, he Court further ordered that this matter

         be set for a final hearing on damages and attorneys’ fees.

      3. Pursuant to the Summary Judgment Order and Section 9-11-40(c)(2),

         Plaintiff hereby requests that this matter be formally placed on this Court’s

         non-jury trial calendar for a hearing as soon practicable.
