PLEASE TAKE NOTICE that upon the motion of Jane Fisher-Byrialsen, dated January
11th, 2023, the undersigned will move this Court, in the Motion Submission Part Courtroom
(Room 130), at 60 Centre St, New York, NY 10007, on Monday the 30th day of January 2023, at
9:30 a.m., for a continuance of the above captioned matter such that incoming counsel can be
afforded a reasonable opportunity to prepare.
Take further notice that pursuant to CPLR 2214(b) any responsive papers and any
notice of cross-motion, with supporting papers, if any, shall be served at least seven days before
the return date of the instant motion..

Petitioner, Sune Gaulsh, by his attorney, Jane Fisher-Byrialsen, Esq, submits the instant
motion for a continuance in order to afford incoming counsel a reasonable opportunity to prepare
for oral argument.
Undersigned counsel has just begun a capital case in California and will not be able to
appear in person in Manhattan until March, for which dates of availability can be submitted. I am
however available for Microsoft Teams appearances before that, if the Court so desires.
WHERFORE, it is respectfully requested that a continuance is granted.
