Sup. Ct., Westchester Cty.) Dear Justice Jamieson: I write on behalf of Class Plaintiffs in regards to their now-unopposed Motion to Confirm the Twenty-Second Report and Recommendation (the “Motion”) (Dkt. 1501). In an effort to avoid unnecessary delay and imposition on the Court, Class Plaintiffs asked Houlihan Lawrence to consent to confirmation of the Discovery Referee’s latest ruling (Dkt. 1509). Houlihan Lawrence ignored that request, putting Class Plaintiffs to the burden and expense of bringing the Motion, but then did not file an opposition prior to its January 13, 2023 statutory deadline, thus continuing its strategic use of the inherently slow-moving confirmation process to stall the progress of merits discovery. To keep the case moving towards a 2023 trial, Class Plaintiffs request prompt entry of the Proposed Order (Dkt. 1510) submitted in connection with the Motion.
