Dear Counsel:
As you know, we had noticed depositions in defense of our client, Texas SAI, Inc. in the
above-referenced matter for Tuesday, January 21, 2020 ofthe following individuals:
1. Joel Garcia, P.E. with Texas Department of Transportation;
2. Rene Garza, P.E. with Texas Department of Transportation; and
3. Martin De La Fuente, Inspector with Texas Department of Transportation.
We are herein informing you that the depositions of the above referenced individuals
scheduled for Tuesday, January 21, 2020 have been quashed and will not be moving forward as
noticed. Enclosed please find the document, Non-Party Texas Department of Transportation's
Motion to Quash and for Protective Order which was filed just this afternoon. We confirmed
with the Attorney General's Office filing the motion that the deponents would not be appearing
and may ask for counsel to be present during any examination under oath.
Finally, as per a License Agreement with the Texas Department of Transportation we are
currently unable to supplement with any of some of their documents related to the above
referenced matter and project file to third-parties and so, need to all work through this with the
Texas Department of Transportation.
We apologize but the motion was just filed this afternoon. Further, we are herein
requesting that you all give us availability for the above mentioned depositions early next week,
so they can be renoticed so the deponents actually show up and also provide any further
documentation and/or the restrictions on licensing be resolved.
