AT WATERBURY MASON,DAVID PHILIP 1/11/2023 ORDER ORDER REGARDING: 08/24/2022 366.00 MOTION FOR JUDGMENT The foregoing, having been considered by the Court, is hereby: ORDER: The court, in its order on entry #364, allowed the late filing of the Substituted Complaint. This motion raises only the timeliness of the filing. The movant, in its reply, for the first time raises the issue that the Substituted Complaint does not comply with Practice Book §10-44, which requires that substituted pleadings be accompanied by a document showing the additions and deletions made to the previous filing. While the movant is correct, a party cannot raise an issue for the first time in a reply brief. The motion is therefore denied, howvevr, the plaintiff is ordered to file a new Substituted Complaint that complies with Practice Book §10-44, on or before 1/23/23.Failure to do so will result in a dismissal of the claims made against this movant. As a result, ##385 and 395, the request to revise and objection thereto, are marked off.
