Ti;r now moves to diamiss the amended complaint and the croyo-clalm on the
grounds that the vicarious liability claim Is
pre-empted by operation of the Graves
Amendment (see 4-9 U,S,C. § 30'106ta)), and the boilerplate negligent maintenance claim
fails .stato u cuu.se of action because
TLTdooas not engage in the maIntennncR / service
or repair of vehicles leased through authorized Toyota dealersWps,
Plaintiff opposes the motion noting that the Splnelli Defendants have failed to
execute a stipulation discontinuing the action again,stTLT,"an'd waiving the
opporlunll-y to a.ssert in the future an affinnulive defense of medtanical defect,"
In reply, T1.,T notes that the complaint asserts no claim of a
mechanical defect,
and the attempt to raise this r\ew theory of liability for the first time by way of an
attorney affirmation Is Improper.
