Circuit Court of the Twelfth Judicial Circuit
sarasota County, Florida Case No. 2007CA07757SC
To whom it may concern:
On February 15 of this year | filed an injunction against my husband for abuse
due to alcoholism. The injunction was filed at the Venice Court House (Sarasota
County). | enlisted services from Legal Aid at the time, and waited for a Pro-
Bono lawyer until recently when one was appointed to me to handle divorce
proceedings. My husband has been out of the house since that date. | also
enlisted the help of a realtor, Mr. Walter Grohosky, with Capital Properties, to list
my home for sale. At that time, the house was not in arrears. However, since
there were no longer two incomes | could not pay the mortgage alone. Indymac
was given the realtors name and asked that he keep in contact with them with
any prospects. He has whole-heartedly tried to show the house on several
occasions, also listing with MLS. We also have lowered the asking price twice,
because the market is so slow and saturated. | fully understood at the initial
listing that it would be hard to sell the home and that foreclosure would probably
be inevitable. This is where | am now. On top of all this, | now have a lawyer
who is trying to resolve the marriage and help me with child support payments
and the like. | will also probably have to file bankruptcy soon since everything
was always in my name. | have effortlessly worked with Indymac and the realty
company to try and sell my home. | am at a cross-road now. | need to take care
of my two children and make sure that | find a suitable home for them since we
cannot afford to live in ours any longer. It saddens me that it had to come to this
point, but living with an alcoholic is not what | wanted my kids to grow up
accepting. | understand that after foreclosure has been filed | have 3 months to
vacate the property. ! will actively be looking for suitable accommodations for us
shortly.
| will send a copy of this written response to the plaintiffs attorney, E. Tyler
Samsing, Esq., Echevarria, Codilis & Stawiarski. Thank you for your time and
consideration.
