BEFORE ME, the undersigned authority, being duly authorized to administer oaths and ;
take acknowledgments, personally appeared CONRAD WIRRIES, who being by. me first: ‘duly i
sworn, deposes and says:

1. | have been appointed as an Agent for the Liquidating Agent of the NATIONAL |
CREDIT UNION ADMINISTRATION BOARD (NCUA Board), acting in its capacity.as:
Liquidating Agent for Huron River Area Credit Union (Credit Union). | am over the age
of 18, sui jris, and authorized to make this affidavit.

4. The National Credit Union Administration is an independent agency of the United States _
Government charged with the involuntary liquidation of some state chartered federally
insured credit unions and federally chartered insured credit unions.

3. The NCUA Board pursuant to section 207/(a)(3) of the Federal Credit Union Act, 12
U.S.C. §1787(a)(3) placed the Huron River Area Credit Union into involuntary
liquidation on November 17, 2007 and appointed itself as Liquidating Agent for the
Huron River Area Credit Union.

4. As Liquidating Agent, the NCUA Board is authorized to take possession of and enforce
cohection of the books, records, assets and property of the credit union and to sue in
the name of the liquidating agent and in the name of the credit union and to execute

such documents and to do such acts as may be necessary to wind up the affairs of the

Credit Union is hereinafter sometimes referred to as “Plaintiff.”

3. IN my capacity as Agent for the Liquidating Agent, | am personally familiar with the
Note, Mortgage, payment history, and property involved in this cause and the status on
said account. All allegations of the complaint are true and correct and are hereby
incorporated by reference as though the complaint was verified by me.

6. Plaintiff is the owner and holder by Assignment of the Note and Mortgage, which is the
subject of this action, copies of which were attached to the complaint previously filed
herein.

f. The Defendant(s) who executed the Note and Mortgage has defaulted under the terms
of said note and mortgage by failing to make the payment due on February 6, 2007.
Piaintiff has heretofore declared the full amount due and payable under said note and
morigage. There is now due and owing and unpaid from the Defendant(s) the following
sums:

Principal Balance $ 241,285.00
Interest from February 6, 2007 at 9.250 percent.
(Per diem rate of $61.15)

8. Plaintiff has obligated itself to pay its attorney a reasonable fee.
- 9. _ The original Note, Mortgage and Assignment from the original mortgagee to ihe Huron
~ River Area Credit Union will be fled with the court at the hearing on Plaintiffs Motion for. os
/ | Summary Judgment, in ‘support of which this affidavit is filed.
