Keiser Restaurant Suppliês LLC ANSWER to the above-mentioned action is asfollows:
On or about August 1, 2019, Keiser Restaurant Supplies, LLC, received a quotation from the Plaintiff,
Luzon Oil Company Inc,in the amount totaling $7375.00. (Quotation 19.5203).
On September 13, 2019, Keiser Restaurant Supplies LLC, Defendant, paid invoice 3616 totaling $783.00,
by credit card, which was part of quotation 19.5203 as indicated on our receipt.
On September 20, 2019, check number1680 was written to Luzon Oil Co, inthe amount of $4,000.00,
and was deposited inthe Piaintiff'saccount on 10/04/2019.
Total payments toward quotation number 19.5203 are $4783.00.
Keiser Restaurant Supplies LLC, Defendant, withheid $2,592.00 until a resolution could be agreed upon
between Luzon Oiland Keiser Restaurant Supplies LLC, since the final billwas in excess of 50% over the
quotation price or a total exceeding the quote of $3, 687.50. Additionally, Keiser Restaurant Supplies
never received a closing of the spillcase from the NY DEC which was part of the agreement/quote.
Itis Keiser Restaurant Supplies LLC contention in addition, the scope of quotation 19.5203 had not been
completed since Keiser Restaurnt Supples LLChas never received the final paperwork from the NY DEC
closing the spilicase.
Keiser Restaurant Supplies LLC, defendant, acknowledges that a balance is owed to Luzon Oil Company
in the amount of $2,592.00, when the closing of the spillcase isreceived by the NY DEC acknowledging
allwork was completed to their satisfaction which Luzon should have provided alldocumentation to the
NY DEC as part of our quotation.
