Please be advised that the owners of the above referenced property have retained us to conduct an audit of
the property's water and sewer tax files.A Letter of Authorization isalready on file.
Please accept thisas our initialappeal of the decision dated 8/10/21.
BBL 1/345/7503 represents 148 Attorney Street, a newly constructed 6-unit building.
Acet #40001-03221-001 billed Code 484 for ACC forthe period of 11/18/18-8/12/20. This ACC was
issued due toa TOS violation, which was corrected on 7/31/20.
Please note thiswas billed Code 484, which isbased on service size, and is used for commercial
buildings, however thisproperty isa 6-unit building, and therefore should have been billed Code 480/481
on ACC. I have attached documentation from DOB showing thisas a 6-unit residential building.
The denial letterdated 8/10/21 stated that our lettercannot be considered, as the customer did not appeal
the 3/1/21 decision issued by the Deputy Commissioner. I have attached a copy of the Customers appeal
dated 9/18/20 as well as the Deputy Commissioners decision dated 3/1/21. The customer was contesting
the ACC in fullas they complied with the violations. However, our claim isnot contesting that the ACC
was not valid,rather we are contesting that DEP billedthem the incorrect rate,as they billed them as a
commercial property, when in fact thisis a residentialproperty. This is a new dispute and should be
treated as such.
Attached please find an email string with Rita Lefkowitz from the Water Group and Andrew Rettig, Chief
of Revenue Protection, from 2019, regarding a different property with a similar situation. In that case,
Chief Rettig agreed thatsince the issue they were discussing was not addressed in the prior administrative
decision, the merits of the dispute would be considered. This isexactly what we are requesting here. The

prior dispute and administrative decision did not discuss that the account was billed the wrong ACC rate
as itis a residential building. As such, we are requesting thisappeal be reviewed.
Based on this information, please cancel Code 484 for the period of 11/18/18-8/12/20 and rebillfor 1
Code 480 and 5 Code 481, as this isa 6-unit residential building.

When ACC are imposed on an account, itwill remain the monthly method of water and
billing
sewer charges untilaccess to thewater meter and/or service lineis provided. ACC will resultin
you paying significantlyhigher water and sewer ratesfor service.
On July 31,2020, domestic meter H18266475 and fire/sprinklermeter Bl9086273 were legally
installed,via DEP permits. On August 12,2020, a DEP fieldinspector revisited theproperty
and found both meters set properly,sealed the meters, and installeda new Meter Transmitting
Unit on the outer surface ofthe property. On February 19,2021, the ACC was prorated as of
August 12, 2020. Subsequent meter charges were issued forthe service period August 2020

to February 19, 2021 totaling S330.69, based on actualwater usage recorded for theproperty.
Also, the associatedlate payment charges (interest) S301.31 were reversed.Please be

I am writing in regards to the attached response letter received for the above-referenced account.
As previously stated, the building is currently under construction (DOB #123039808) and does not yet
have a Certificate of Occupancy. The project received Site Connection approval from DEP on May 2,
2017, and the two required meters for this building were installed on April 26, 2019 and May 1, 2019.
The meters were inspected and meter-reading devices connected on August 12, 2020.

I am asking respectfully that the "Theft of notice and any associated penalty charges are
rescinded, and that we are charged for direct water consumption charges only. I am attaching several
documents and photos as evidence of when work was performed and consumption during the period in
question.
