PLEASE TAKE NOTICE that upon the annexed Affidavit of Aviram Chen, managing
member of Third-Party Plaintiffs, 676 East 179 LLC and DNA Management Group LLC, sworn
to on December 1, 2022, the annexed Affirmation of Leon I. Behar, Esq. dated December 1,
2022, the exhibits annexed hereto, and upon all the prior pleadings and proceedings heretofore
and herein; Third-Party Plaintiffs shall move before one of the Justices of this Court, the Hon.
Lucindo Suarez, at the Supreme Court of the State of New York County of Bronx, located at 851
Grand Concourse, Room 411, Bronx, New York 10451, on the 28th day of December, 2022 at
9:30 a.m., or as soon thereafter as counsel may be heard, for an Order:
(a) pursuant to CPLR 3215(a), (e), entering a default judgment against Rudy’s
Service’s Inc. (“Third-Party Defendant” or “Rudy”) on the first cause of action in
Third-Party Plaintiffs’ Verified Third-Party Complaint, dated September 12, 2022
(the “Third-Party Complaint”) based on the failure of the Third-Party Defendant

to appear and/or answer the Third-Party Complaint in this action and granting
