The Court has Mr. Halpern's May letter seeking a conference. The Court's
recollection is that at the last conference, the Court directed plaintiffs to winnow
down the second amended complaint to reflect solely the remaining causes of
action. Once that is done, defendant shall answer what will be the third amended
complaint. The Court wishes to make plain that it does not make any finding that
the second amended complaint contains - or does not contain -
"inadmissible,
prejudicial"
scandalous and material.
As an aside, counsel may fax to the Court e-filed letters of fewer than three pages
(914-824-5885). (Idid read Mr. Vest's 17th letter even though we have not
