The Court has Mr. Hal pern 's May 16th l etter seeking a conference. The Court's
recollection is that at the last conference, the Court directed plaintiffs to winnow
down the second amended complaint to reflect solely the remaining causes of
acti on. Once that i s done, defendant shall answer wh at will be t he t hi rd amended
complai nt. The Court wi shes to make plain that it does not make any finding t hat
the second amended complaint contains - or does not contain - "inadmi ssible,
scandalous and prejudicial" material.
As an aside, coun sel may fax to t he Court e- filed letters of fewer than three pages
(914-824- 5885). (I did read Mr. Vest's May 17th letter even th ough we have not
yet received a Worki ng Copy, on the assumption that it should be arriving any
day.)
