PLAINTIFF’S AFFIDAVIT IN SUPPORT OF DAMAGES AWARD

 

Plaintiff, D&J NAPLES INVESTORS, LLC, hereby files its Affidavit in Support of
Damages Award, and swears on the following.

1. I, DAVID JOYCE, am one of the managing members of D&J Naples Investors,
LLC (the “Company”), the Plaintiff in this action and the owner of the property
that is the subject of this lawsuit. I am over the age of 21 and understand the
obligations of an oath.

2. The Company retained attorney Mark E. Adamczyk, Esq. and the law firm of
Peck & Peck, P.A. to file this action in order to remove the cloud on title cast by
Defendants.

3. The Company has reviewed its counsel’s affidavit of attorney’s fees and costs

incurred on this matter and agrees with that affidavit and states under oath that
those amounts were paid by the Company.
