Dear Judge Cacace,
We represent the Petitioner-Plaintiff ONEDOL Rock Holdings LP (“Plaintiff”) in the above-
referenced action. In furtherance of my discussion with Your Honor’s law clerk this afternoon
concerning the proposed briefing schedule in this matter, this letter will confirm that all parties,
by their counsel, have consented to a revised briefing schedule in this matter as follows:
• On or before September 13, 2021, Plaintiff shall file and serve a Supplemental Brief in
Support of the Petition/Complaint’s claim challenging the constitutionality of the Village
of Scarsdale’s Historic Preservation Law (the “Supplemental Brief”);
• On or before October 18, 2021, Defendants shall file and serve their opposition to
Plaintiff’s Supplemental Brief;
• On or before November 18, 2021, Plaintiff shall file and serve its reply to: i) Defendants’
opposition to the Supplemental Brief; and ii) Defendants’ opposition to the Petition’s
Article 78 claims (which already have been filed with the Court).
• The Petition/Complaint will be returnable on, and fully submitted to the Court by,
November 19, 2021.
We appreciate the Court’s assistance in this matter.
