NOTICE OF ABATEMENT
Comes the Defendant, Benjamin S. Ramsey (the “Debtor”), by counsel, and without
waiving any affirmative defenses or objections to venue or jurisdiction, hereby notifies the Court
and the parties herein that this cause of action is presently stayed as a result of a voluntary
Chapter 7 Petition for relief under the Bankruptcy Code filed by the Debtor on September 16,
2010 in the United States Bankruptcy Court for the Eastern District of Kentucky, Case No. 10-
52945. The continuation of this action against the Debtor is hereby automatically stayed
pursuant to 11 U.S.C. § 362, and no party may proceed herein without first obtaining an order of
the United States Bankruptcy Court for the Eastern District of Kentucky. This Notice of
Abatement should not be considered an entry of appearance herein on behalf of the Debtor by the
undersigned counsel.
WHEREFORE, the Debtor gives notice that no further action is permitted in this case
against the Debtor unless the automatic stay is modified to permit same.
