Your Honor:
I write to provide an update concerning the above-referenced case. As the Court is aware,
on August 17, 2022, Plaintiffs filed a [Proposed] Order to Show Cause seeking preliminary approval
of a settlement that had been reached with certain defendants. NYSCEF Doc. 158. Today, Plaintiffs
have reached a Memorandum of Understanding with the remaining defendants (Infinity Q Capital
Management, LLC, Infinity Q Management Equity, LLC, Bonderman Family Limited Partnership,
Scott Lindell, Leonard Potter, and James Velissaris) (the “Remaining Defendants”). Pursuant to
this agreement, the parties have completely resolved the claims in this action.
In light of the agreement reached today with the Remaining Defendants, Plaintiffs
respectfully request until September 7, 2022, to file a revised [Proposed] Order to Show Cause,
along with supporting documentation, so that the Court may consider the proposed global settlement
in its entirety. If it is convenient for Your Honor, the parties are available and propose to have the
preliminary approval hearing for the global settlement at a date and time convenient for Your Honor
during the period of September 12, 2022 through September 15, 2022.
We are grateful for Your Honor’s time and attention to this matter.
