August 24, 2015; and upon all prior papers, pleadings and proceedings heretofore and herein,
Defendants will be making a cross-motion before this Court upon the hearing of Plaintiff’s main
motion for an Order expunging the satisfaction of mortgage recorded on March 8, 2011, and for
other relief, which motion will be heard at IAS Part ____ of the Supreme Court of the State of
New York, held in and for the County of Westchester, at the Courthouse located at 111 Dr. Martin
Luther King Jr. Boulevard, White Plains, New York 11601, on the 31st day of August, 2015 at
9:30 a.m., or as soon thereafter as counsel may be hear for an Order:
(a) pursuant to RPAPL § 1501 declaring that Plaintiff’s mortgage is discharged and
legally ineffective to establish a claim by Plaintiff of title to the premises; and/or
(b) for such other and further relief that this court finds is just and equitable.
PLEASE TAKE FURTHER NOTICE, that pursuant to CPLR § 2214, answering and/or
opposing affidavits, if any, are to be served upon the undersigned at least one day before the
return date of this motion.
