Oral Report Date: 5/9/2021 Scott Clippinger, an attorney admitted to the practice of law in the State of New York, hereby affirms under penalty of perjury: 1. I am an attorney representing the Appellants herein, Sandele & Daniel Wenzel. The Wenzels were, on May 9, 2021, foster parents to a male child. The foster placement was made by the Madison County Department of Social Services (Suzanne Coffin was the principal caseworker in Madison County), whereas the Wenzels and the child resided in Chenango County. 2. The Office of Children and Family Services has indicated a report wherein the Appellants were alleged to have exercised negligent supervision. The Wenzels requested expungement of same, were denied, and appealed. The parties have completed two days of hearings. NO. 2 RECEIVED NYSCEF: 09/02/2022 has testified to the existence of certain records maintained by the Madison County Department of Social Services with regard to this case. All prior records introduced in evidence have been from the Chenango County Department of Social Services. 3. The matter has been adjourned to September 26, 2022 at 1:30 p.m. for the continued cross-examination of Ms. Coffin. The Madison County Department of Social Services records regarding this foster placement are necessary to provide Appellants a fair and equitable hearing on their appeal. WHEREFORE, your affirmant prays for the issuance of a Subpoena Deuces Tecum for the caseworker records relating to the foster placement with the Appellants of the subject child, and for such other and further relief that this Court deems just and proper.
