This matter comes before the Court upon the motion of Plaintiff for Findings of Fact and
Conclusions of Law. However, the Court would note that the journal entry dated September 16,
2014, which granted Defendant’s motion for default judgment, required this matter to be set for a
hearing on damages due to the fact Plaintiff's claim is still pending.
Therefore, the Court finds the judgment entered in favor of Defendant on January 5, 2015
to have been issued in error. As such, said judgment is hereby vacated. This matter shall be set
for a hearing upon Plaintiff's claims and damages on Defendant’s counter-claim.
Due to the ruling vacating the judgment rendered on January 5, 2015 Plaintiff's request
for findings of fact and conclusions of law is denied as moot.
