MORSE GELLER affirms the following pursuant to the penalties
of perjury:
1. I am the attorney for the plaintiff in this matter and am fully
familiar with the facts and circimstances of this case.
2. The within matter is being submitted for judgment against the
defendant, YAILIN VIDAL, and I submit this affidavit
in support hereof under the Soldier's and Sailor's Civil Relief
Act of 1940.
3. Pursuant to the Soldier's and Sailor's Civil Relief Act of 1940, as
amended and pursuant to ordinary office procedures, an investigation
by my office staff to determine whether or not the aforesaid defendants
were in the armed services of the United States of America or New
York State. In that investigation my staff contacted the Department
of Defense Manpower Data Center via the Internet requesting the
defendant's military status.
4. Based on inputting the defendant's social security number, that
was provided to our office by the plaintiff, it was learned that
YAILIN VIDAL was not, in fact, in the armed services of the
United States of America or New York State. This investigation took
place on 05/12/21.
5. I further state that I have read and am familiar with the Act of
Congress known as the Soldier's and Sailor's Civil Relief Act of 1940,
as amended, and am particularly familiar with the sections of said
Act which define persons in military service.
6. I am satisfied that the named defendant is not serving in the armed
services of the United States of America or New York State.
