                  PLEASE TAKE NOTICE, that upon the Affirmation of Brian L. Battisti, Esq., the

          accompanying Memorandum of Law, the exhibits annexed thereto and all of the supporting

          pleadings and proceedings heretofore had, the defendant, FLEMINGTON ELECTRICAL

          MAINTENANCE, INC. (“Flemington”), will move this Court before the Kings County

          Courthouse located at 360 Adams Street, Brooklyn, New York on September 10, 2021 at 9:30

          a.m., or as soon thereafter as counsel can be heard, for an Order:

                  1.       Pursuant to C.P.L.R. § 3212, for summary judgment dismissing the Plaintiff’s

          Verified Complaint, as it pertains to Flemington, and all counterclaims and cross-claims that

          pertain to Flemington; and

                  2.       Such other and further relief as this Court may deem just and proper.
