Dismissal With Prejudice as entered into between counsel on behalf of the parties, and
the Court being advised in the premises it is hereby,
ORDERED AND ADJUDGED that the parties’ Stipulation for Final Order of
Dismissal with Prejudice is approved and accordingly the above-styled action is hereby
dismissed with prejudice with the parties having reached accord and satisfaction on all
issues, and agreement regarding costs and attomey fees such that each party shall
bear its own costs and fees. The lien transfer bond posted in the above-styled action by
Intervenor, AMERICAN BUILDING CONTRACTORS INSURANCE RESTORATION
SERVICES, INC., and insured by surety, Old Republic Surety Company, bond number
RCT5143025, shall be released forthwith and extinguished, with same being without
further force or effect. The Court retains jurisdiction for purposes of enforcement of the
November 27, 2020, Amended Confidential, Conditional Settlement Agreement between
Plaintiff and Intervenor, including the reciprocal releases as contained therein.
