PLEASE TAKE FURTHER NOTICE, that a copy of the aforementioned Exhibit "B" (depicting the location where Sublessee shall store its garbage until collected by Sublessor's garbage disposal service) is attached hereto as Exhibit B, and that the aforementioned Exhibit "C" (depicting the location where Sublessor and its subtenants other than Sublessee may store garbage until collected) is attached hereto as Exhibit C. PLEASE TAKE FURTHER NOTICE, that Sublessee has violated and continues to violate a substantial obligation of its tenancy in that, in violation of paragraph 3 of the Second Floor Expansion Sublease, Sublessee has illegally and intentionally removed the garbage and garbage containers of Sublessor's subtenants from the designated area marked in Exhibit C hereto and placed the garbage and garbage containers on the sidewalk and street. PLEASE TAKE FURTHER NOTICE, that Sublessee is required to cure the aforementioned default on or before July 13, 2016, that being more than twenty (20) days after the service of this Notice upon Sublessee, and upon Sublessee's failure to so cure, Sublessor will elect to cancel and terminate Sublessee's tenancy and the Second Floor Expansion Sublease in accordance with paragraph 19 of the Overlease, as incorporated by paragraph 5 of the Original Sublease, and as further incorporated by paragraph 2 of Second Floor Expansion Sublease, and applicable provisions of law. Section II — Utilities PLEASE TAKE FURTHER NOTICE, that paragraph 9 of the Original Sublease, as incorporated by paragraph 2 of the Second Floor Expansion Sublease, provides in relevant part, that: 9.5. NO. 161 RECEIVED NYSCEF: 10/12/2017 Premises measuring all water consumption in the Sublease Premises and all other water consumption by or on behalf of the Subtenant, if there is no such meter or submeter as of the date of this Sublease. The Subtenant will also provide to the Sublandlord periodic reports (upon the request of the Sublandlord but not more often than monthly) of all water consumption reflected on such meter. The Subtenant shall also promptly pay (not later than the applicable due date) (1) to the applicable utility or governmental unit the cost of all water consumption reflected on such direct meter, and (2) to Sublandlord, as Additional Rent, the cost of all water consumption reflected on such submeter. If at a future time, the City of New York (or any of its departments or agencies), or any other governmental unit, imposes additional charges with respect to water and sewer for the entire Overlease Premises, then the Subtenant shall pay the Subtenant's Proportionate Share of such additional charges. PLEASE TAKE FURTHER NOTICE, that Sublessee has violated and continues to violate a substantial obligation of its tenancy in that, in violation of paragraph 9 of the Original Sublease, as incorporated by paragraph 2 of the Second Floor Expansion Sublease, Sublessee has failed to install a water submeter to measure Sublesee's water consumption at the Second Floor Expansion Premises.
