AFFIDAVIT OF FACTS AND SALE OF ACCOUNT BY ORIGINAL CREDITOR

The undersigned, being duly sworn, deposes and says:
1. I am an employee of Synchrony Bank ("OriginalCreditor") formerly known as GE Capital Retail
Bank and on June 2, 2014, GE Capital Retail Bank formally changed itsname to Synchrony
Bank, and I have persGnal knowledge of and access to Original Creditor's books and reccids
. ("Business Records"), including electronic records, relating toa pool ofcharged-off consumer
credit accounts sold or assigned by Synchrony Bank to Sherman Originator IIILLC ("Debt
Buyer"), on 6/21/2019 (the "Sale"),which included the account ("Account") of the consumer
("Consumer") XXXXXXXXXXXX7232 and identifiedin theexhibits attached hereto and
incürperated herein. As partof the Sale, Original Creditor assigned allof itsinterest in the
Account, including the rightto any proceeds from the Accounts, toDebt Buyer, and it transferred
Business Records relatingto the Account to Debt Buyer. A trueand correct copy ofthe bill
of sale
or writtenassignment of the Account is attached as an exhibit tothis affidavit.
2. in my position,I also have personal knowledge of Original Creditor's procedures forcreating and
maintaining itsBusiness Records, including itsprocedures relatingto the sale and assignment of
consumer credit accounts. Original Creditor's Business Reccids were made inthe regular course
of business and it wasthe regular course of such business to make the Business Records. The
Business Records were made at or nearthe time of the events recorded. Based on my
knowledge of Original Creditor's Business Records, I have personal knOwledge of the factsset
forth inthis affidavit.
3. Original Creditor and Consumer were parties to a creditagreement ("Agreement"). Consumer
agreed to pay Original Creditor for allgoods, services and cash advances provided pursuant to
the Agreement. The date and the amount of the last payment, if any,made by Consumer are set
forth inan exhibit attached hereto and made a parthereof. A true and correct copy of the terms
governing the account at the time of charge-off isattached as an exhibit to thisaffidavit.
4. At the time of Sale, Consumer owed the amount set forthinthe exhibits attached hereto and
made a parthereof, which also set forth the name ofthe Consumer; the lastfour digitsof the
Account number; the date and amount ofthe charge-off balance; the date and amount of the last
if the total ifapplicable, of post-charge-off interest and post-charge-
payment, any; amounts, any
offfees and charges; and post-charge-off creditsor payments made by or on behalf of the
Consumer; and the balance due atthe time ofthe Sale. The above statements are true and
correct to the best of my personal knowledge.
