Boddie Justice of the Supreme Court 360 Adams Street Brooklyn, New York 11201 Re: Kopelowitz v Moskovitz and Lichtenstein Supreme Court Kings County Index No. 527036/2019 Dear Justice Boddie: On June 2, 2022 Plaintiff’s Counsel efiled a letter representing to the Court that the Court’s directive regarding the turnover of documents has not been complied with. From the letter I can only presume that Counsel wrote the letter because he is not aware that after the hearing in Court the parties have, without participation of counsel, been negotiating the terms of a settlement. Settlement conversations are being facilitated through a mediator who the parties accepted to mediate a resolution. The requested financial documents were sent to the Mediator via Dropbox several weeks ago in accordance with the agreement of the parties. Further, drafts of settlement and non-disparagement agreements were exchanged by the parties. The process has taken a bit longer than anticipated as the mediator had a family matter to attend to and Mr. Kopelowitz left to Israel in the last week in May and I understand will return to New York after the Jewish holiday that ends on Monday evening next. The expectation is that this entire matter can be completed and resolved by in the next several weeks.
