PRESENT: HON. LEON RUCHELSMAN
The plaintiff has moved pursuant to CPLR §5206 seeking a
sheriff’s sale concerning property located at 929 East 5 th Street
in Kings County. This action is an action for a confession of
judgement. The action seeking the sale of such property is a
different action entitled Kopelowitz v. Lichtenstein et al.,
Index Number 504897/2020. The petition in that action references
the confession of judgement and seeks the sale of the property in
partial satisfaction of the confession of judgement. The precise
amount owed pursuant to the confession of judgement is
$3,076,907.71 as of October 23, 2020. That amount was calculated
by a referee which the court appointed. The court hereby adopts
the conclusions reached by the referee. Although the order to
show cause seeking the sale of the property is based on a
petition in the other action there is no reason why the order to
show cause cannot be considered at this time. Both actions
essentially concern the same confession of judgement and the same
relief. The mere filing the order to show cause in this action
