FIRST AMENDED INFORMATION
IN THE NAME AND BY THE AUTHORITY OF THE STATE OF FLORIDA:
BE IT REMEMBERED that BRUCE H. COLTON, State Attorney for the Nineteenth Judicial
Circuit of the State of Florida, prosecuting for the State of Florida, in Indian River County, under
oath, information makes that in Indian River County:
COUNT 1: On or Between February 22, 2019 and February 23, 2019 Brent A. Westberry did
intentionally touch or strike Joanna L. Fricke against that person’s will or did intentionally cause
bodily harm to said person, and at the time of the battery Joanna L. Fricke was a law
enforcement officer who was engaged in the lawful performance of a legal duty, and the
defendant knew Joanna L. Fricke was a law enforcement officer, in violation of Florida Statutes
784.03 and 784.07(2)(b);
COUNT 2: On or about February 22, 2019 Brent A. Westberry did unlawfully resist, obstruct or
oppose Joanna L. Fricke, a duly authorized law enforcement officer in the lawful execution of
the officer’s legal duty, without offering or doing violence to the person of said officer, in
violation of Florida Statute 843.02;
contrary to the form of the Statute in such case made and provided, and against the peace and
dignity of the State of Florida.
