Upon the foregoing documents and for the reasons set forth on the record (1.21.2022), the
motions are denied. However, to the extent that Fiorello Pharmaceuticals, Inc. (Fiorello) wishes
to seek discovery on the Contingent Share Escrow Agreement (the CSEA), such limited
discovery will be permitted.
Fiorello shall email Part 53 (sfc-part53@nycourts.gov) by January 31, 2022, to inform the court
whether it seeks limited discovery on the CSEA. If an email is not received by January 31, 2022,
Fiorello will have been deemed to forfeit its right to seek further discovery on the CSEA. Cresco
Labs New York, LLC and Cresco Labs LLC (collectively, Cresco) shall respond to Fiorello’s
demands by February 3, 2022.
