ORDER ON DEFENDANT’S AMENDED MOTION TO CONSOLIDATE
THIS COURT having heard argument from counsel, on Monday October 21st of
2019, on Defendant's Amended Motion to Consolidate, with related case SFR Services,
LLC a/a/o Ted Monty v. First Protective Insurance Company DBA Frontline Homeowners
Insurance, Case No. 11-2018-CA-001240-0001-XX, and counsel in the related case,in
which a similar motion is pending, were also present for the hearing, and the Court being
fully apprised of the matter makes the following rulings:
1. The Court GRANTS the Defendant's Amended Motion to Consolidate with
respect to the discovery process.
2. The Court notes for the record that the related case of SFR Services, LLC
a/a/o Ted Monty v. First Protective Insurance Company DBA Frontline Homeowners
Insurance, Case No. 11-2018-CA-001240-0001-XX, has completed arbitration, and has
been set for trial by Judge Brody for the November and December 2019 trial dockets.3. As such, the Court DENIES Defendant's Amended Motion to Consolidate
with respect to trial, and therefore retains jurisdiction on the issue of TRIAL. The
consolidation shall not delay the trial docket of the related case of SFR Services, LLC
a/a/o Ted Monty v. First Protective Insurance Company DBA Frontline Homeowners
Insurance, Case No. 11-2018-CA-001240-0001-XX.
