PLEASE TAKE NOTICE, that upon the Affirmation of Yelena Graves, Esq., dated
the 17th of February, 2022, with exhibits annexed thereto, the Affirmation in Good Faith
of Yelena Graves dated the 17th day of February, 2022, and all pleadings and proceedings
previously had herein, Defendant, 1137 E. 223RD CORP d/b/a FAITH CHRISTIAN
ACADEMY, will move this Court before the Hon. Andrew J. Cohen in the Supreme Court,
Bronx County, at the Courthouse located at 851 Grand Concourse, Bronx, New York,
10451 on the 18th day of March, 2022 at 10:00 am or as soon thereafter as counsel can
be heard, for an Order: (1) pursuant to 22 N.Y.C.R.R. 202.21(e), vacating the Note of
Issue and striking the Certificate of Readiness filed by Plaintiff, and striking this matter
from the trial calendar on the grounds that discovery remains outstanding, (2) extending
the deadline for filing dispositive motions, and (3) granting such other and further relief as
to this Court seems just and proper.
PLEASE TAKE FURTHER NOTICE, pursuant to C.P.L.R. § 2214(b), answering
affidavits, if any, are required to be served upon the undersigned at least seven (7) days
before the return date of this motion.
