Petitioner’s Petition for Writ of Administrative Mandate came on regularly for hearing
on June 4, 2009, at 9:30 a.m., in Department 302 of the above captioned court, the Honorable
Charlotte W. Woolard, Judge Presiding. Albert J. Garcia, Attorney at Law, appeared on behalf
of the Petitioner; Edmund G. Brown, Jr., Attorney General, by Richard D. Marino, Deputy
Attomey General, appeared on behalf of the Respondent.
Afier reviewing and considering the moving and opposing papers and all other
documents filed in this matter, and having heard and considered ora! argument,
IT IS ORDERED that the Petition for Writ of Administrative Mandate be denied, with-~
prejudice, The Petitioner was properly served with the Notice of Hearing for the administrative
proceeding and defaulted by failing to appear. The Respondent properly issued a DefaultDecision and Order revoking the Petitioner’s physician and surgeon’s certificate based upon the
affidavits of competent medical experts pursuant to its authority under Government Code section
11520
