Courts of the State of New York, affirms under penalties of perjury the following:
1. I am the attorney for the plaintiff in the above entitled action and I am fully
familiar with all the facts.
2. This action is brought to recover damages sustained by the plaintiff by reason of
personal injuries sustained, as a result of a motor vehicle accident which occurred on December 1,
86th
2020, on East Street and Third Ave., New York, NY.
3. While there is no police, the documentation exchanged at the scene indicate that the
"Brana"
defendant Richard Brana , was the operator of the offending bus with address 108
Continental Avenue, Belleville, NJ 07109, copy of the documentation exchanged annexed hereto
as"Exhibit A".
4. The New Jersey State Department of Motor Vehicles confirmed that defendant Brana as of
December 27, 2021 resided at 108 Continstal Avenue, Belleville, NJ 07109, of firstpage of
copy
Driver History search annexed hereto as "Exhibit B".

5. That on the day of December, 2021, a Summons and Verified Complaint was served
upon the Secretary of State of New York at his office, 99 Washington Avenue, Albany, NY ,
DOCS\AFFIRMAT\COMPLIA3.VTL.

together with a fee of ten ($10) dollars with respect to defendant Brana, pursuant to the
provisions of Section 253 of the Vehicle and Traffic Law of the State of New York. As evidence

of said Service, annexed as exhibit is an affidavit of service and report for service from State
of New York Department of State.
6. Thereafter, on December 15,2021, notice of such service, and a copy of the Summons
and Verified Complaint with Notice of Electronic Filing was sent to defendant Brana, enclosed
in a securely sealed wrapper, addressed to defendant, with sufficient postage and by certified
mail, with a request for return receipt, copy of Affidavit of Service amexed hereto as exhibit
"D". Said postal service issuing a receipt for said mailing, the original of said receipt annexed
hereto and made a part hereof as Exhibit "E".

7.Annexed collectively as Exhibit is the return receipt showing receipt on Decemeber
20, 20210f the Notice and copy of the Summons and Verified Complaint mailed to said defendant
Brana. A copy of the Summons and Verified Complaint with Notice of Electronic Filing sent to said
defendant Brana are annexed hereto collectively as Exhibit "G".
8. All of the aforementioned are in complete compliance with service upon the non-
resident defendant Richard Brana pursuant to the provisions of Section 253 of the Vehicle and
Traffic Law of the State of New York.
